'Construction regulations in Idukki applies across the state': SC
 
Thiruvananthapuram: The Supreme Court order stating that the regulation of constructions on assigned land should not be confined to Idukki district, but should be made uniform across the state and hence to all other districts is a setback to the state government.

The apex court bench headed by Justice Abdul Nasser and Justice Sanjay Khanna questioned the state government's contention about how the regulation can be confined to a single district.

The Supreme Court also dismissed the petition filed by Kerala against the High Court order which stated that rules mentioned in the Kerala Land Assignment Rules should be implemented across the state. SC asked the state government if there weren’t assigned land in other districts.

Meanwhile, the environmental activists welcomed the apex court's direction and stated that the move is in the right direction towards protecting the environmentally sensitive areas within the state.

“There are nearly 20,000 acres of land in Wayanad, Palakkad and Kozhikode district combined which are now in a legal tussle between the government and the real state lobby. The current order by the apex court will now force the government to give away these protected lands mostly in western ghat zones to private players," said KS Madhu, an environmental activist based in Kasaragod.

The Kerala HC on January 30th had asked the state government to make No-Objection certificates from village office mandatory for issuing a building permit for construction on assigned lands across the state.

On September 25, 2019, the local-self-government had issued an order requiring such NOCs from village office mandatory for construction on assigned lands in Idukki.

This was following an order issued by the High Court on August 22, 2019. The court had then asked the government to implement the NOC rule within two months and also to amend the building rules so as to make the NOC mandatory in Idukki district.
