Petition in HC seeks Cheriyan's disqualification
Kochi: A petition has been moved in Kerala High Court seeking the disqualification of former minister Saji Cheriyan from the post of MLA following his remarks against the Constitution of India.
A Division Bench of Chief Justice S Manikumar and Justice Shaji P Chaly will look into the petition alleging that the CPI(M) leader insulted the constitution by making controversial remarks in a public function, sources said.
Advocate P. K. Pretheep Kumar appeared for the petitioner on Tuesday and argued that Cheriyan violated Article 173 (a) and 188. A case has already been registered against the MLA under the Insults to National Honour Act, 1971, he added.
Earlier, Keezhvaipur Police filed a case against former Minister Saji Cheriyan, who resigned from the second Pinarayi Vijayan Cabinet over his anti-Constitution remarks.
This was after the Thiruvalla Judicial First Class Magistrate Court directed the Keezhvaipur police SHO to register a case against Saji Cheriyan on his controversial remarks.
The court order was on the basis of a petition filed by advocate Baiju Noyal hailing from Kochi. Tiruvalla DySP Rajappan Ravuthar is probing the case against the MLA.
Another nine complaints also pending before the DySP seeking to register cases against the MLA representing Chengannur Assembly Constituency for his controversial speech at a party programme in Mallappally.
